Overtime Rules in Taiwan

The daily threshold is 8 hours and the weekly threshold is 40 hours. Hours worked beyond either point count as overtime and are paid at 1⅓× the regular rate.

Where a figure is not shown, Taiwan does not set that threshold nationally, or it is left to a collective agreement. Check the source before applying it to a specific contract.

No maximum weekly hours figure is listed for Taiwan: the statute cited below does not set one as a weekly ceiling. Daily limits, annual overtime caps and minimum rest periods may still apply, so read the source before planning long weeks.

A rest break of at least 30 minutes applies once a shift exceeds 4 hours. Unpaid breaks are excluded from paid hours, which is how the hours calculator treats the break field by default.

Some hours are priced by the kind of day they fall on rather than by how many hours were worked. The rates below are statutory minimums in Taiwan, and an agreement may set more. The calculator applies the daily and weekly thresholds above, not these: it cannot know which day of your week was a rest day or a holiday, so apply them yourself.

Work on a weekly rest day is paid at not less than 1⅓× the ordinary hourly rate.

On the statutory day off, work is permitted only in an emergency, and is then paid at not less than 2× the ordinary hourly rate together with a compensatory day of rest.

Work on a holiday is paid at not less than 2× the ordinary hourly rate.
